Article 1 – Authorized Vehicle Operation
Persons over 21 years of age, who have held a valid driver's license for a minimum of 2 years (2 x 365 days), are authorized to operate the vehicle.
Under no circumstances should the vehicle be operated in the following cases:
1. by a person not designated as the Lessee or Driver/Additional Driver in the Agreement,
2. by a person under the influence of alcohol, sedatives, narcotics, sleeping aids, or other drugs,
3. for paid passenger or cargo transport,
4. outside the borders of BiH, except with the prior written consent of the Lessor,
5. for participation in sports competitions, speed trials, or races,
6. for towing or pulling any vehicle or object,
7. when the vehicle is not in roadworthy condition or is overloaded with excess passengers or luggage,
8. by violating legal conditions and regulations relating to the use, loading, or condition of the vehicle, or for any illegal purposes.
These restrictions do not exclude each other. Any costs/fines incurred as a result of non-compliance with these restrictions will be charged to the Lessee, regardless of the insurance coverage. The Lessor's liability is fully excluded.
Article 2 – Vehicle Pickup and Return
The Lessee takes over the vehicle in technically sound condition and returns it in the same condition as received, except for normal wear and tear, at the exact time and place specified in the Rental Agreement. The Lessor is not responsible for any damages suffered by the Lessee due to delayed vehicle delivery. If, for any reason, special vehicle cleaning is required, the cost will be charged to the Lessee.
Article 3 – Rental Extension
If the Lessee wishes to extend the rental period, they must notify the Lessor or the Lessor's representative who rented the vehicle to them at least 1 day (24 hours) in advance and enter into a new Rental Agreement. Otherwise, it will be considered that the Lessee has unlawfully appropriated the vehicle, and the Lessor will notify the relevant authorities accordingly.
Article 4 – Mileage
The short-term rental agreement includes an unlimited number of kilometers traveled. For long-term rental agreements, the allowed mileage is specified in the Agreement.
Article 5 – Fuel
The Lessee takes over and returns the vehicle with a full tank of fuel. Otherwise, the Lessee will be charged the cost of fuel up to the full tank according to the Lessor's valid price list.
Article 6 – Vehicle Maintenance
The Lessee is obliged to treat the rented vehicle as a careful custodian and ensure that the rented vehicle is always properly locked and with closed windows when left unattended, and that the vehicle documents are kept with the Lessee (never in the vehicle).
The Lessee is obliged to regularly check the engine and oil, as well as the water in the radiator, battery, and tire pressure. The Lessee is obliged to change the engine oil every 10,000 km, exclusively at the Lessor's service. The Lessee is responsible for all damages caused by inadequate vehicle maintenance.
If the vehicle reaches the mileage at which regular service is due during the rental period, the Lessee is obliged to inform the Lessor and bring the vehicle exclusively to the Lessor's service. The Lessee does not bear the cost of regular service performed outside the Lessor's service if written consent has been obtained to do so.
Article 7 – Repairs
All repairs and/or replacements of vehicle parts may only be performed at the Lessor's service centers. Otherwise, the Lessee is liable for any resulting damage.
If any part of the vehicle is replaced or lost without authorization, the Lessee will be charged damages in the amount of three times the market value of that part.
In the event of malfunctions caused by negligence or carelessness of the Lessee, the Lessee bears the cost of repairs as well as lost profits.
If, due to a malfunction, the rented vehicle is not in roadworthy condition, the Lessee is obliged to secure the vehicle from further damage and immediately inform the Lessor.
The Lessor is not liable for any damages suffered by the Lessee due to vehicle malfunctions during the rental period. Except for the changes specified in this article, the Lessee is not authorized to make any other changes to the vehicle.
Article 8 – Documents
The lessee takes over the vehicle with all necessary documents. In the event that the lessee loses any of the documents, keys, registration plates, etc., they will be additionally charged for any incurred costs according to the lessor's price list.
Article 9 – Vehicle Insurance
All vehicles of the Lessor are insured against liability for damage caused to third parties.
Under no circumstances does insurance cover:
1. any damage caused intentionally or negligently,
2. theft, if the Lessee does not have the vehicle keys and documentation (especially the registration certificate),
3. any damage or loss of the vehicle not reported to the competent police station or for which there is no police report,
4. tire damage,
5. damage to the lower part of the vehicle, gearbox, and clutch, interior of the vehicle, and windshield caused by driver negligence,
6. engine damage caused by lack of oil, incorrect fueling, or negligent use of the vehicle,
7. damage caused by a driver under the influence of alcohol, drugs, or similar substances,
8. damage caused by an unauthorized driver,
9. any damage to the vehicle not reported to the competent police station.
In all the above cases, the Lessee will be liable for the amount of damage up to the value of the vehicle as well as for the amount of lost profit incurred in the respective case.
In the event of any damage, traffic accidents, or vehicle theft, the Lessee is obliged to immediately notify the Lessor and report the incident to the competent police station.
Article 10 – Passenger Insurance
For an additional daily fee, according to the valid insurance price list, passengers are insured up to the amount of the insurance policy in case of death or disability as a result of an accident involving the rented vehicle.
Article 11 – Damages
The Lessee is responsible for any loss or damage to the vehicle caused by their intent or negligence or as a result of non-compliance with the Agreement or General Terms, and is obliged to cover all damages incurred in this manner as well as lost profits up to the full value of the vehicle, except in cases where liability is waived by paying a daily supplement for certain types of insurance determined by the Lessor's current price list of Insurance Services.
Article 12 – Loss of Property
The Lessor is not responsible for any damage or loss of the Lessee's property or the property of others stored or transported in or on the rented vehicle, service vehicle, or Lessor's premises. By signing this agreement, the Lessee expressly waives any claim for compensation from the Lessor in the event of the aforementioned damage or loss.
Article 13 – Sublease
The Lessee is not allowed to sublease the rented vehicle unless expressly authorized in writing by the Lessor.
Article 14 – Payment of Bills
Vehicles are rented at a daily rate in accordance with the current price list, where one day means a period of 24 hours from the conclusion of the Rental Agreement. Payment is made exclusively by credit card if the Lessee is a natural person, except when otherwise approved by the Lessor. When signing the Rental Agreement and taking over the vehicle, the Lessee must provide a credit card pre-authorization. If the rental period expires and is not paid in advance, the Lessor will charge the vehicle rental as well as all incurred costs based on the credit card slip (completion).
In addition to the rental cost, the Lessee is obliged to pay all other expenses falling on them according to the General Terms and the Lessor's current price list.
By signing this Agreement, the Lessee confirms their agreement that the Lessor may, at the expense of their credit card or by any other means of payment, charge all costs of repairs, breakdowns, or losses discovered within 24 hours after the vehicle is returned, and about which the Lessee has not informed the Lessor in accordance with the vehicle return procedure. Also, the Lessor is authorized to charge in the same way the cost of all traffic violations and parking and other fines incurred during the rental period, increased by any handling costs.
Article 15 – Inspection and Confiscation of Vehicles
The Lessor has the right to inspect any vehicle at any time. If it is found that the Lessee violates any provision of the Agreement or General Terms, the Lessor is authorized to confiscate the vehicle and immediately terminate the Vehicle Rental Agreement.
Article 16 – Personal Data
Copies of the Lessee's personal documents must be attached to the Rental Agreement.
The Lessee voluntarily provides personal data, which will be used solely for the Lessor's needs. The Lessee authorizes the use of their personal data for the purpose of the Lessor's marketing activities. The Lessor may request that the Lessee leave one of their original documents with the Lessor for the duration of the rental period, with the Lessee's prior consent.
Article 17 – Amendments and Supplements
Amendments and supplements to the Agreement and General Terms are valid only in writing.
If any provision of these General Terms were to be invalid, it shall not affect the validity or nullity of the Agreement or the entire General Terms.
Article 18 – Guarantees
By signing, the Lessee unconditionally accepts the Lessor's General Terms and guarantees compliance with the minimum age requirements for operating a motor vehicle, as well as the accuracy of all provided information, and accepts the jurisdiction of the Court in Sarajevo in case of a legal dispute.
By signing the Rental Agreement and General Terms, the Lessee confirms their agreement that the payers of all costs incurred under the Vehicle Rental Agreement are:
1. Lessee
2. Driver – in case the Lessee refuses to pay the obligation under the Vehicle Rental Agreement in full or in part
3. Additional driver – in case the Lessee or the driver refuse to pay the obligation under this vehicle rental agreement in full or in part
